TENAYA CREEK HOMEOWNERS ASSOCIATION
RULES AND REGULATIONS

PREAMBLE:
The Board of Directors of TENAYA CREEK ASSOCIATION is by the Declaration of Covenants, Conditions and Restrictions, vested, empowered, and charged with the duty, responsibility, and authority, to adopt and enforce RULES AND REGULATIONS governing the conduct of all persons living in, or visiting, TENAYA CREEK HOMEOWNERS ASSOCIATION, INC.
The following RULES AND REGULATIONS are adopted to protect property values, to keep the Owners' investments secure, and to ensure that all members of the ASSOCIATION shall have a pleasant environment in which to live.
The Board of Directors of the ASSOCIATION is empowered to levy penalties and assess fines for violations of the RULES AND REGULATIONS and other governing documents. Monetary fines may become Recorded Liens against the property of Owners so committing violations unless said penalties are paid within 90 days from notice. These RULES AND REGULATIONS do not supersede the Bylaws and / or covenants, conditions, and restrictions.
GENERAL:
1. Owners are responsible for their tenants' dependents', and guests' observance of the RULES AND REGULATIONS; and are responsible and liable for any damage / repair costs within Common Areas caused by their tenants, dependents, and guests; and are responsible for any liability claims resulting from use of Common Area facilities by their tenants, dependents, and guests.
2. No owner shall permit or suffer anything to be done which obstructs or interferes with the rights of quiet enjoyment of the other occupants, or annoy them by unreasonable noises, or otherwise, nor will any owner commit or permit any nuisance on the premises.
3. The owner of a unit shall be ultimately responsible for insuring that his or her lessee complies with the Association's Declarations, Articles, Bylaws, and these Rules and Regulations.
4. Sound levels within or outside a residence, including but not limited to audio, mechanical, human and pets shall be courteous and not offensive. All Nuisance ordinances enacted by Washoe County or the City of Reno shall be considered to be Restrictions and shall be strictly enforced and referred for prosecution.
5. Residential Use Only. The lots of the subdivision may be used for single-family residential purposes only. Commercial use is prohibited.
6. Common Areas and Residences:
A. Shall be kept free of litter, trash, bottles, cans, and wood or storage piles of any kind.
B. Outbuildings. No portion of any uncompleted building, nor any tent or garage or outbuilding erected or maintained on Properties shall at any time used as a residence, temporarily or permanently.
C. No garbage, refuse or trash shall be kept on any common area or limited common element or residential lot. All trash and garbage for collection shall be securely placed within trash cans and or bags. Any trash that is left on common areas or streets that is not picked up will be dispose of by the Association and bill back to the owner of the residence... Recycled items are to be contained in the recycle plastic bins along with the bagged newspapers and magazines. Securely closed trash bags and trash cans may be placed at curbside no earlier than 6 p.m. on the Wednesday before collection and put away no later than 7 p.m. on Thursday after collection.
D. Weeds/Brush. No rubbish, brush, weeds or unkept lawns shall be
permitted.
E. The Board of Directors, in its sole discretion, shall make all decisions regarding the extent, type, design, and general appearance of exterior from the face of home to street (ex: fences driveways, retaining walls stair landing and porches) lawns and landscaping.
F. It is the Homeowner and / or occupant's responsibility to dispose of Christmas trees. Reno Disposal will pick up certain sized trees during a certain period of time. For more information you should call Reno Disposal (775) 329-8822.
G. All holiday decorations must be removed 3 weeks after the holiday.
H. No signs or other advertising devise of any character shall be erected or maintained upon any lot in the subdivision. Except the following; on any one parcel one sign, not larger than four square feet, advertising the property for sale may be erected and maintained behind the setback line of such parcel to any street. Signs necessary for the sales models and sales offices, construction jobs signs, and the two billboard signs near the U.S. Highway.
I. All homeowners with rock or anything other than grass will be required to keep it cleared away from and off of all common areas including but not limited to the streets.6. Pets
A. No cattle, swine, or other livestock fowl, or other animals, other than dogs, cats, two or less, or other common and ordinary household may be kept within the Tenaya Creek Homeowners Association.
B. Pets may not be tethered in any common area.
C. All pets must be kept on a leash, and control must be maintained by owner at all times within the Association. County and City ordinances pertaining to pets shall apply to this Association. If any pet becomes a general nuisance, restrictive action will be taken. All animals must be the responsibility of their owners. Damage to shrubbery, or other common area, by animals will be at the expense of the owner.
D. Pets shall not be allowed to defecate or urinate in the Common areas. In the event of accidental defecation, the pet owner or the person responsible for the pet must immediately remove the droppings and the pet owner shall be liable for all damage to grass turf or property resulting from pet defecation or urination.
E. Pet Owners shall be responsible for preventing annoying dog barking / and or vicious dogs.
F. The Homeowner and / or occupants shall indemnify and hold the Association harmless from any and all damage and / or injury incurred by any animal owned by or under the control of the Owner and / or occupant.
7. Please note that the costs for maintenance requirements by the Homeowners Association of Tenaya Creek, on common property, will depend, in large measure on the care and consideration exercised by each and every homeowner/tenant and their guests.
STREETS AND PARKING:
1. The speed of any vehicle driven within Association property shall not exceed Fifteen (15) miles per hour. Owners are especially requested to impress this regulation on dependents, guests, or tenants.
2. No Off Road vehicles will be allowed with in the Associations Street.
3.Streets are not to be used by unlicensed motorcycles, or motor operated vehicles or by anyone not licensed to operate a vehicle on a public street. Streets serving the Association may not be used as a playground area or for use of skates, skateboards, scooters, wagons, tricycles, bicycles and other propelled vehicles.
4. The Association through its officers, committees and agents is hereby empowered to establish "parking and no parking" areas within the Association property.
5. No vehicle shall be parked on the common area at any time. No parking is allowed in front of mailboxes. No parking is allowed on side yards between homes.
6. Owners are responsible for the observance by guests or tenants of the street parking regulations.
7. No inoperative vehicle of any kind or type, i.e., flat tires, inoperative and / or unregistered, shall be allowed within any street parking area or any portion of the common area for more than twenty-four (24) hours. Any vehicle that is parked on the corners painted red, will be towed without notice at the owner's expense.
ARCHITECTURAL:
Architectural Committee. To establish an Architectural Committee whose function shall be to enforce the restrictions, establishes Rules and Regulations governing the use of the Properties, and oversees the maintenance of the Association Property. Any work to be done on the exterior of any home or lot shall be submitted for approval to the Architectural Committee by mailing said plans to 5011 Meadowood Mall Way Suite 200 Reno Nevada 89502 .
1. Fences: No fence shall be erected or permitted to remain between the street and the front set back line in excess of four feet in height, nor shall any fence, well or hedge placed or erected on a lot be more than six feet in height nor shall any fence be allowed to be a sight barrier at any Subdivision Street intersection.
2. Outbuildings. No portion of any uncompleted building, or any tents or garage or outbuilding erected or maintained on Properties shall at any time be used as a residence, temporarily or permanently.
3. Soil removal: No sand, gravel or soil shall be removed from Properties unless suitable retaining walls are constructed to support the earth, the natural angle of repose of the ground shall not be altered by excavation within ten feet of the boundary line of subject premises.
4. Home Appearance: All homes must comply with the following requirements andrestrictions.
A. All exterior base colors must be approved by the Architectural Committee
B. All exterior trim must be painted white.
C. All cooling units must be out of sight from the Subdivision Street in front of the home, and contained behind side or rear yard fencing. No roof mounted cooling units will be permitted in the Residential Areas.
D. All roofs must be black and no "3 tab shingles" will be permitted in the Residential Areas
E. Diseased trees: The Association may enter upon any Residential Area at any reasonable time to inspect for, prevent and control diseased trees and other plant life and insect infestation of trees and other plants. If any diseased or insect infested trees or other plant life are found, the Association may spray, remove diseased trees and other plant life, and take such other remedial measures, as it deems expedient. The Association as a Special Assessment pursuant to this Declaration may levy the cost thereof attributable to any one or more lots against each such lot(s).
5. Satellite Dishes
A. Satellite Dish may not be any larger than 24 inches and must be placed toward the back of the home
B. Any Satellite Dish larger than 24 inches must be placed in the backyard out of view from the street.
6. Landscape
A. All front landscape must be complete within one (1) year from date of purchase.
B. Flag poles not to exceed 36 to 48 inches on angular pole off front of home or porch pillars. No flags may be tacked or otherwise hung off any portion of the home or fence. In ground poles are not permitted.
